PMTANALYTICS & TRACKING TOOL

Acceptable Use Policy

Effective Date: August 26, 2026 · Last updated: August 26, 2026

This Acceptable Use Policy ("AUP") sets the rules for using PMT (pmt.today), operated by Anthony Esposito, a sole proprietor doing business as PMT ("PMT," "we," "us," or "our"). It is part of, and incorporated into, our Terms of Service. Capitalized terms have the meanings given in the Terms. If you violate this AUP, we may act under "Investigation and enforcement" below and under the Terms. Contact: pokemonmarkettracker@gmail.com.

PMT's market archive, analytics, scores, and written commentary are the product of significant work and are the core of our business. Much of this AUP exists to protect that work and to keep the Service fast, secure, and available for legitimate users.

1. Scope

This AUP applies to everyone who accesses the Service, whether or not signed in, and to any tool, script, or agent used to access it.

2. General rule: lawful, personal use

Use the Service only for lawful purposes and for your own personal, non-commercial use, consistent with the Terms and the limited license granted there. Do not use the Service in any way that violates any applicable law or regulation or infringes anyone's rights.

3. Account integrity

Keep your account secure and use only the Discord account you are entitled to use. You are responsible for activity under your account. Do not access, or try to access, any account, data, or area that is not yours.

4. No account or credential sharing

Your account and access are personal and non-transferable. Do not:

5. No unauthorized access

Do not attempt to gain unauthorized access to the Service, other users' data, our systems, or any connected service, whether by exploiting a vulnerability, misusing credentials, or any other means.

6. No paywall or entitlement circumvention

Do not bypass, disable, or interfere with sign-in, access controls, the paywall, or premium-entitlement checks, and do not attempt to access premium data or features you have not paid for — including by manipulating client-side code, tokens, or requests.

7. No automated access, scraping, or bulk extraction

Except through features we expressly provide for the purpose, do not use bots, crawlers, spiders, scripts, headless browsers, or any automated means to access, monitor, copy, or extract data or content from the Service. In particular, do not:

8. No API or endpoint abuse

Do not access PMT's data endpoints other than as the Service's normal interface intends. Do not send excessive, automated, or malformed requests, or use the Service in a way that places an unreasonable load on our infrastructure.

9. No reverse engineering of proprietary logic

Do not reverse engineer, decompile, or attempt to derive or reconstruct PMT's proprietary scoring, weighting, thresholds, curation, or analytics logic, whether from the Service's output, its code, or otherwise, except to the limited extent this restriction is prohibited by law.

10. No redistribution, resale, or republication

Do not redistribute, resell, republish, sublicense, broadcast, or otherwise make available PMT's data, analytics, rankings, or commentary to any third party, except limited personal, non-commercial quotation with attribution as allowed by the Terms.

11. No database reconstruction or competing use

Do not use the Service, or data or analytics obtained from it, to build, populate, or improve a competing product or service, to reconstruct or approximate PMT's database or analytics, or as input to any dataset intended for those purposes.

12. No AI/model training on PMT data

Do not use PMT's data, analytics, or commentary to train, fine-tune, or evaluate any machine-learning or artificial-intelligence model, or to create derived datasets for that purpose, without our prior written permission.

13. No interference with security or availability

Do not interfere with, degrade, or disrupt the Service, its security features, or its infrastructure, including through denial-of-service activity, flooding, or probing, and do not attempt to defeat rate limiting, bot mitigation, or the web application firewall.

14. No malicious code

Do not upload, transmit, or introduce any virus, malware, or harmful code, or use the Service to distribute any of the above.

15. No fraud or impersonation

Do not use the Service for fraud, including subscription or chargeback fraud, and do not impersonate any person or entity or misrepresent your affiliation.

16. No intellectual-property infringement

Do not infringe PMT's or any third party's intellectual-property or other rights, including by misusing Pokémon-related marks or artwork, TCGplayer content or images, or any third-party material. Copyright complaints are handled as described in Section 21.

17. Community conduct

PMT's community lives on Discord. Conduct in that community is governed by Discord's Terms and Community Guidelines and the PMT server's rules. Do not harass, threaten, or abuse others, or post unlawful or infringing content, in any PMT-operated space.

18. Reasonable use

Do not use the Service in a way that is excessive relative to normal personal use, or that degrades the Service for others.

19. Authorized integrations and permitted uses

We may authorize specific automated access, integrations, or data uses in writing. If you want to use PMT's data beyond personal use — for research, an integration, or an API arrangement — contact us at pokemonmarkettracker@gmail.com to request written permission. The following ordinary activities are always permitted: normal human browsing; using your own account, watchlist, and portfolio; requesting an export of your own data where offered; sharing a public PMT page or link; and access by search engines or integrations we have expressly authorized.

20. Good-faith security reporting

We welcome good-faith reports of security vulnerabilities. If you believe you have found one, please report it to pokemonmarkettracker@gmail.com and give us a reasonable chance to fix it before disclosing it publicly. Good-faith research and reporting that follows this section, does not harm users or data, does not violate privacy, and does not disrupt the Service will not be treated as a violation of this AUP or the Terms. Do not access more data than necessary to demonstrate an issue, and do not exfiltrate, alter, or destroy data.

21. Copyright complaints

If you believe content in the Service infringes your copyright, send a notice to pokemonmarkettracker@gmail.com with: identification of the work, identification of the material and its location in the Service, your contact information, a statement of good-faith belief that the use is unauthorized, a statement that your notice is accurate, and your signature. We will respond appropriately, which may include removing infringing material and terminating repeat infringers.

22. Investigation and enforcement

We may investigate suspected violations and take any action we consider appropriate, including issuing warnings, applying rate limits or challenges, blocking IP addresses or networks, suspending or terminating accounts, revoking sessions, removing content, preserving evidence, and cooperating with providers or authorities where legally required or appropriate. For serious violations — such as scraping, security attacks, fraud, or account sharing — we may act immediately and without prior notice.

A note on what enforcement can and cannot do: these measures raise the cost and difficulty of abuse and let us respond to it, but no set of technical controls can prevent every scraping or misuse attempt. This AUP defines what is not permitted regardless of whether a given attempt is technically blocked.

23. Suspension and termination

Violations of this AUP are violations of the Terms and may result in suspension or termination of your access as described in the Terms, including forfeiture of remaining subscription time without refund in cases of serious misuse.

24. Changes to this AUP

We may update this AUP from time to time. If we make material changes, we will update the "Last updated" date and provide reasonable notice through the Service. Continued use after a change takes effect means you accept it.
