These Terms of Service ("Terms") are a legal agreement between you ("you," "your," or "User") and Anthony Esposito, a sole proprietor doing business as PMT ("PMT," "we," "us," or "our"), located in New Jersey, United States, operating the website and application at pmt.today and related services (together, the "Service"). Please read these Terms carefully. By creating an account, signing in, or using the Service, you agree to these Terms and to our Privacy Policy and Acceptable Use Policy, which are part of this agreement. If you do not agree, do not use the Service.
PMT is an informational and analytical tool for the Pokémon Trading Card Game ("TCG") collectibles market. It collects publicly available price data for English and Japanese Pokémon TCG singles and sealed products, archives it daily, and turns it into indexes, rankings, temperature and trend indicators, support-line detection, a written market journal, and personal tools such as a watchlist and portfolio. PMT provides information and analytics only. See Section 21 (No financial advice) and Section 15 (Market data).
You must be at least 13 years old to use the Service. The Service is not directed to children under 13, and we do not knowingly collect personal information from them (see the Privacy Policy). To purchase or hold a paid Premium subscription, you must be at least 18 years old, or have a parent or legal guardian who agrees to these Terms and manages the subscription on your behalf. By using the Service you represent that you meet these requirements and that the information you provide is accurate.
Access to the Service requires an account, which you create by signing in with Discord (OAuth). When you sign in, we receive limited information from Discord — your Discord user ID, username, avatar, and email address — as described in the Privacy Policy. You are responsible for your Discord account and for all activity under your PMT account.
Your account is personal to you and non-transferable. You may use it on your own devices, but you may not share your account, credentials, or access with anyone else, or sell, rent, or transfer access. See Section 16 (Sharing) and the Acceptable Use Policy.
Access to PMT's market terminal — including its data visualizations, charts, rankings, screeners, indexes, and analytics — requires a paid Premium subscription. Signing in alone does not provide access to the terminal. We may make limited features available to signed-in users without a subscription, and we may change which features are free and which require Premium, add or remove features, and set the boundaries of each tier at our discretion. Where a change materially reduces a paid feature you are actively paying for, we will act reasonably and consistently with Section 12 (Changes to paid features) and applicable law.
Premium is a recurring subscription currently priced at $9.99 per month. The current price is always the price shown at checkout and on our Pricing page, and if the two ever differ the checkout price governs. Checkout, billing, and subscription management are handled by Whop, which acts as the merchant of record for Premium purchases — your purchase is processed by Whop, and Whop's own terms apply to the payment transaction. We never receive or store your full payment card details.
Except where a refund is required by applicable law, subscription fees are non-refundable, and we do not provide partial or pro-rated refunds for the unused portion of a billing period. When you cancel, you keep Premium access through the end of the current paid period, and you are not charged again. Refunds, where applicable, are processed by Whop as the merchant of record, in accordance with its refund process. Nothing in this section limits any non-waivable rights you may have under New Jersey or other applicable consumer-protection law.
Your Premium access ends, and your account returns to free (or logged-out) status, in each of these cases:
Losing Premium does not delete your account or your saved data. We keep your account, desks, and preferences so they are available if you resubscribe, unless you ask us to delete them (see the Privacy Policy and Section 19).
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal, non-commercial purposes. This license does not transfer any ownership. All rights not expressly granted are reserved.
You may take screenshots and quote limited amounts of PMT data for your own personal, non-commercial use, with attribution to PMT. Any other use — including the prohibited activities in Section 9 and the Acceptable Use Policy — requires our prior written permission.
Your use of the Service is governed by our Acceptable Use Policy, which is incorporated into these Terms. Without limiting it, you agree not to:
We may enforce these rules as described in Section 18 and the Acceptable Use Policy.
The Service lets you save personal content — watchlists, portfolio holdings and cost basis, price alerts, research notes, labels, and preferences (your "User Content"). Your User Content is private to your account and is not published or shared with other users by PMT. You keep ownership of your User Content. You grant us a limited license to store, process, and display it back to you solely to operate the Service for you. You are responsible for your User Content and for keeping your own records; PMT is a tool, not a system of record for your finances (see Section 15).
The Service — including PMT's software, design, text, the structure and selection of its data, and its proprietary analytics, scores, indexes, rankings, temperature and reliability indicators, support-line logic, and written market commentary — is owned by PMT and is protected by intellectual-property laws. "PMT" and "pmt.today" are our unregistered trademarks. Except for the limited license in Section 8, nothing in these Terms gives you any right in our intellectual property.
We may modify, suspend, or discontinue any part of the Service. If we discontinue a Premium feature you are actively paying for in a way that materially reduces the value of your subscription, your remedy is to cancel; we are not liable beyond that except as required by law.
PMT is an independent product. It is not affiliated with, endorsed by, or sponsored by The Pokémon Company, Nintendo, Game Freak, Creatures Inc., TCGplayer, Discord, Whop, or any other third party, unless an actual written agreement says otherwise. PMT participates in TCGplayer's affiliate program (see Section 22); taking part in a retailer's affiliate program is not an endorsement by, or an affiliation with, that retailer.
Pokémon names, characters, card names, set names, and artwork are the property of their respective owners. Card images displayed in the Service are served from TCGplayer and belong to TCGplayer and/or the rights holders; PMT claims no ownership of them. Underlying market prices originate from TCGplayer; PMT owns the archive and analytics it builds from that data, not the underlying price data itself. Third-party names and logos are the property of their owners.
The Service relies on third-party services — including Discord (sign-in and community), Whop (payments, as merchant of record), Supabase (accounts and data), and Cloudflare (hosting and security). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services, and links to third-party sites are provided for convenience only.
PMT's data and analytics are provided on an "as-is" and "as-available" basis. You acknowledge that:
Your account is for one person. You may sign in on your own devices, but you may not share your account or access with anyone else, or resell, sublicense, or transfer it. Account sharing, reselling access, or paywall circumvention are grounds for suspension or termination (Section 18) and may forfeit remaining subscription time without refund.
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation, and we may perform maintenance, change, or discontinue the Service or any feature at any time. We may offer experimental or "beta" features, which are provided as-is, may be changed or withdrawn, and may be less reliable.
You may stop using the Service at any time and may cancel your subscription as described above. We may suspend, restrict, or terminate your access, remove content, or revoke your session, with or without notice, if we reasonably believe you have violated these Terms or the Acceptable Use Policy, engaged in scraping, fraud, chargeback abuse, account sharing, security attacks, or other serious misuse, or where required to protect the Service, other users, or comply with law. For minor issues we may give you notice and an opportunity to correct where practical.
On termination for cause, your license ends immediately, remaining subscription time may be forfeited without refund, and we may retain data as described in the Privacy Policy and as required by law. See Section 19 for what happens to your data.
If you stop using the Service or cancel Premium, we keep your account and saved data so it is available if you return, unless you ask us to delete it. You can request deletion of your account and data at any time by emailing pokemonmarkettracker@gmail.com or opening a ticket in our Discord; we will delete it as described in the Privacy Policy (subject to limited retention required by law, such as payment records held by our payments provider). On request, and where available, we can provide a copy of your saved desk data before deletion.
To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that data will be accurate or complete. Nothing in these Terms excludes or limits any warranty or right that cannot lawfully be excluded or limited, including under New Jersey law.
PMT is not a broker, dealer, investment adviser, financial planner, appraiser, auctioneer, or tax adviser, and nothing in the Service is financial, investment, legal, tax, or professional advice. PMT's data, scores, and commentary are for informational purposes only. You are solely responsible for your own buying, selling, grading, insurance, tax, and investment decisions. Collectibles are speculative and can lose value. Consult a qualified professional before making financial decisions.
Where the Service references third-party retailers, prices, or availability, those retailers control their own products, prices, inventory, and transactions. Availability can change at any time, including before you complete a purchase elsewhere. PMT is not a party to, and is not responsible for, any transaction between you and a third-party retailer or marketplace.
Affiliate links. Links to TCGplayer product pages in the Service — for example the "View on TCGplayer" button on a product page, the outbound arrow (↗) on rows and tables, and links in PMT's Discord notifications — are affiliate links. PMT participates in the TCGplayer affiliate program, which is operated through the Impact affiliate network. If you follow one of these links and make a qualifying purchase, PMT may receive a commission from TCGplayer. This does not change the price you pay. Affiliate relationships do not influence PMT's prices, scores, rankings, alerts, or editorial content, and information an affiliate network reports to PMT is used only to administer the program — never as an input to PMT's analytics. Affiliate links are identified by the outbound arrow, by their tooltip, and by the disclosure at the foot of every page. TCGplayer's own terms govern your purchase.

Some jurisdictions do not allow certain limitations, so some of these may not apply to you. Nothing here limits liability that cannot lawfully be limited, including under New Jersey law.
You agree to indemnify and hold harmless PMT (Anthony Esposito) from claims, damages, losses, and reasonable expenses (including legal fees) arising out of your misuse of the Service, your violation of these Terms or the Acceptable Use Policy, or your violation of any law or third-party right. This does not apply to the extent a claim arises from our own violation of law.
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules.
Informal resolution first. If you have a dispute with us, please contact us at pokemonmarkettracker@gmail.com first and give us 30 days to try to resolve it informally. Most concerns can be resolved this way.
Courts. If we cannot resolve a dispute informally, it will be resolved exclusively in the state or federal courts located in New Jersey, and you and PMT consent to the personal jurisdiction of those courts, except that either party may bring an individual claim in small-claims court where eligible.
To the extent permitted by law, any claim relating to the Service must be brought within one (1) year after it arises, or it is permanently barred.
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and provide reasonable notice (for example, on the site or through the Service). Changes are effective when posted, and your continued use after that means you accept them. If you do not agree, stop using the Service.
By using the Service, you agree that we may communicate with you electronically (for example, through the Service or Discord), and that electronic communications satisfy any legal requirement that a communication be in writing. Notices to us should go to pokemonmarkettracker@gmail.com; a mailing address is available on request.
You may not assign or transfer these Terms or your account. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
If any provision of these Terms is held unenforceable, the rest remain in effect and the unenforceable provision will be limited or removed to the minimum extent necessary. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy and Acceptable Use Policy, are the entire agreement between you and PMT about the Service and supersede any prior agreements.
